The Cabinet of Ministers of Ukraine adopted Resolution No. 870 "On Amendments to Clause 3 of the Methodology for Calculating the Amount of Fees for Lawyers Providing Free Secondary Legal Assistance", according to which
during the period of martial law, as well as within three months from the date of its termination or cancellation, the amount of the attorney's fee will not depend on the time it took him to submit the act on the provision of free secondary legal assistance.
The draft of the relevant decision was developed by the Coordinating Center for the provision of legal assistance.
"We understand that in wartime, there can be many reasons for lawyers not meeting the deadlines for submitting acts with attachments. They can be in the occupied territories, be called up for military service during mobilization, be evacuated, and so on. However, the amount of lawyers' remuneration depends on the terms of submission of such acts. That is why the Coordinating Center for the provision of legal aid has developed proposals for improving the legislation in terms of payment for the services of lawyers who provide free secondary legal aid in the conditions of martial law," said the Acting Director. Oleksandr Baranov, director of the Coordination Center for Legal Aid.
"It is very important that Resolution No. 870 of the Cabinet of Ministers of Ukraine enters into force from the day of its publication and applies from February 24, 2022, from the beginning of the Russian Federation's large-scale invasion of Ukraine. If the lawyers who completed the provision of free secondary legal aid, for example, in March or April of this year, did not submit the documents with the relevant attachments within the specified period, they can submit them now or later within the period of martial law, as well as within three months from on the day of its termination or cancellation, and receive payment for their services," emphasized Anna Meredova, Head of the Legal Analysis and Expertise Department of the Coordinating Center for the Provision of Legal Aid.
