Digest of Supreme Court Case Law in Citizenship Disputes

We offer you to familiarize yourself with a thematic digest of the Supreme Court case law, which presents the court decisions of the Grand Chamber of the Supreme Court and the Cassation Administrative Court within the Supreme Court in citizenship disputes (court decisions entered in the Unified State Register of Court Decisions for the years 2018–2024) – https://court.gov.ua/storage/portal/supreme/ogliady/Dajidges_VS_gromadyanstvo_2018_2024.pdf

It contains a number of important legal positions of the Supreme Court formulated during the consideration of cases in the order of trial, appellate, and cassation proceedings.

Key issues in such cases included, among others:

1) regarding the acquisition of Ukrainian citizenship:

  • the person’s status as a citizenship applicant as a condition for the President of Ukraine to consider the issue of accepting such person into Ukrainian citizenship;
  • the procedure for establishing a person to determine citizenship affiliation;
  • the procedure for the migration service authorities to formalize the acquisition of Ukrainian citizenship by individuals;

  • grounds for making a decision to cancel the acquisition of Ukrainian citizenship;
  • timelines for considering applications for termination of Ukrainian citizenship;
  • termination of Ukrainian citizenship based on an electronic proposal (petition);
  • procedure for obtaining data confirming the grounds for losing Ukrainian citizenship;
  • sources of obtaining information by the State Migration Service of Ukraine regarding the grounds for a person losing Ukrainian citizenship;
  • evidence in cases of termination of Ukrainian citizenship, and so on.

The digest is the first edition that summarizes the Supreme Court’s case law in public law disputes regarding citizenship, which will be supplemented with new relevant legal positions in the future.
