Ukrainian Bar Association Simplifies Legal Aid Order Form

The lawyer’s certificate number, who and when it was issued, is excluded from the details of the legal aid order form.

The relevant changes to the Regulation on the Legal Aid Order, approved by the decision of the UBA on 12.04.2019, No. 41, were made by the Ukrainian Bar Association during the meeting on June 7, held in the Khmelnytskyi region.

It is worth noting that according to Article 26 of the Law “On Advocacy and Advocacy Activities,” one of the documents certifying the lawyer’s authority to provide legal aid may be an order. It is issued by a lawyer, law firm, or bar association. The standard form of the order is approved by the UBA.

Order forms, according to the approved standard form, are generated in the corresponding section of the “Personal Cabinet of the Lawyer” on the official website of the UBA, following the system commands. The generated orders are automatically recorded by the Unified Register of Ukrainian Lawyers electronic database management system. The history of order generation is displayed in the corresponding section of the “Personal Cabinet of the Lawyer.”

Lawyers, bar associations, or law firms initiate the generation of orders accordingly by lawyers conducting individual legal activities, heads (authorized persons) of the bar association, law firm through the official UBA website, in the regional bar association, or as an exception in cases provided by the UBA directly in the UBA.

The corresponding changes at the technical level will be made to the system in the near future. This directive was given by the head of the UBA, UBA Lidiia Izovitova.

“About forty thousand lawyers currently use the order generation service. And the decision to remove the certificate details from the order form is aimed at eliminating unnecessary bureaucratic requirements without compromising the identification of the lawyer. We strive to make UBA electronic services even more convenient for colleagues’ daily practice, while maintaining proper accounting and control through the ERAU,” commented the changes by the Deputy Head of the UBA, UBA Valentin Hvozdiy. – This is a minor amendment that will facilitate lawyers in formalizing their authority to provide legal aid.”
