Notarial documents will have a QR code

Resolution No. 745 of the Cabinet of Ministers of Ukraine dated July 1, 2022 "On the approval of the Rules for the formation and verification of a notarial document with an electronic identifier" entered into force, which defines the procedure for the formation of a notarial document with an electronic identifier (QR code) in the Unified State Electronic System of e-Notariat ), as well as the procedure for its verification by notaries, state authorities, local self-government bodies, and other interested parties.

The list of notarial documents generated with a QR code and the rules for their accounting in the e-Notary System are approved by the Ministry of Justice. Forming and verification of a notarial document with a QR code is free of charge.

It is forbidden to put text, images, or any other signs on the QR code of a notarial document.

The formation of a notarial document with a QR code can be carried out by a notary who, in accordance with the law, has access to the e-Notary System.

To create a notarial document with a QR code, the notary downloads the electronic draft of the notarial document and enters the following information into the e-Notary System:

1) type of document (according to the dictionary of document types of the e-Notary System);

2) information about the persons in respect of whom the notarial act was performed:

– surname, proper name and patronymic (if available), registration number of the taxpayer's registration card (if available), series (if available) and/or passport number – for individuals;

– name and code according to the EDRPOU – for legal entities;

3) the number under which the notarial act is registered in the register for the registration of notarial acts;

4) the date of the notarial act;

5) surname, proper name and patronymic (if available) of the notary who performed the notarial act;

6) number of the certificate of the right to engage in notarial activity;

7) additional information about the document (if available).

The e-notary system provides automatic overlay of the QR code on each page (in the upper left corner) of the electronic draft of the notarial document.

The electronic draft of the notarial document, after superimposing the QR code on it, is printed on paper and provided by the notary to the parties for signing.

On the day of performing a notarial act of certifying a notarial document with a QR code or certifying the authenticity of a signature on it, the notary uploads an electronic copy of such document, made by scanning, with a qualified electronic signature, to the e-Notary System. Scanning of a notarial document with a QR code, including when it contains more than one page, is made into one file. The text on scanned notarial documents with a QR code must be suitable for perceiving its content.

Making corrections to a notarial document with a QR code, an electronic copy of which is uploaded to the e-Notary System, is prohibited.

A notarial document with a QR code is checked by an interested person, who has been assigned the registration number of the taxpayer's registration card, using an electronic device by scanning the QR code in real time by means of the Unified state web portal of electronic services, in particular using the mobile application of the Diya Portal (Diya ).

According to the results of scanning the QR code on the electronic device of the interested person using the mobile application of the Diya Portal (Diya), information is displayed regarding the absence or presence of the notarial document and information about it in the e-Notary System.

An electronic copy of a notarial document with a QR code is provided at the request of an interested person using the mobile application of the Diya Portal (Diya) with the consent of at least one person in respect of whom a notarial act has been performed and who has been assigned the registration number of the taxpayer's registration card, with a superimposed remote qualified by electronic signature Action Signature (Action ID).

The validity of a notarial document with a QR code cannot be denied solely because the person against whom the notarial act was performed did not give consent for the interested person to receive an electronic copy of the notarial document with a QR code.
