A lawyer who received a certificate and took an oath must, on the same day, submit an application for entering information to ЕРАУ and pay an annual fee. A special procedure has been established for those who have not decided on a workplace.
Corresponding changes to p. 3.2 The procedure for maintaining the Unified Register of Advocates of Ukraine was introduced by RAU decision No. 64 . The document was published on the NAAU website.
According to the updated rules, in order to submit information to the ERAU, on the day of receiving the certificate of the right to practice law and taking the oath, the lawyer must submit an application for entering information about him to the bar council of the region that issued him the certificate of the right to practice law to ЕРАУ and pay the lawyer’s annual contribution to ensure the implementation of the lawyer’s self-governance.
A copy of the certificate of the right to practice law, a copy of the certificate of passing the qualifying exam and a document confirming the address of the workplace must be attached to the application.
If at the time of submission of the application for entering information into the ERA, the lawyer has not decided on the address of the workplace, or intends to practice law in another region, then the information about the address of the workplace shall not be entered into the ERA. In this case, within three days, the lawyer is obliged to make changes to the information about himself in ЕРАУ, providing documented information to the regional bar council, which issued him a certificate of the right to practice law, or apply for a transfer statement.
In the event of failure to submit an application for entering information to the ERAU within the specified period, within three working days from the day of the lawyer taking the oath and issuing the certificate of the right to practice law, the regional bar council shall enter information about such a lawyer into the Unified Register of Lawyers of Ukraine according to the information available in the council , except for information about the address of his workplace.
